What is the point of going after this woman? SHE did not download the songs. She has already disciplined her children. She ahs already served as a poster child .. so what is the point?

Mere possession of copies of songs is not a crime. The fact the someone (and RIAA knows not who) posted the links to the song collection is not a crime. The downloading might be a crime but there is ZERO EVIDENCE that this lady downloaded anything. Or that her children did. Just that someone did.

So if a storekeeper at the end of a busy post Xmas day finds a counterfeit $50 in his cash register should we prosecute him for passing counterfeit bills? Did he accept one .. it seems so. But where is the evidence that he would knowingly pass one?

The principle is the same. Or if third graders xerox a $5 bill and substitute their own pictures in the middle for Lincoln do we prosecute the parent who gave the child the $5?

RIAA is doing this because they can. It is not just. It reeks of thuggery. And such actions undermine the very ethics of the "illegal downloading" cases they wish to believe have a high moral standard. Yes, thievery is wrong and illegal downloading is theft. But chase the downloaders and their fences, not their mothers.

Is there any group that's dedicated to stopping corporate abuse of the legal system against private individuals in general - not just related the RIAA?

I had my own problem with in this past year, and I can't figure out what to do about it. At least in the RIAA situation, these cases are perceived as public matters and can be championed in the press. However, normal people with no resources are being told to "settle or else pay colossal sums to defend yourself" all the time. Yes all the talk about frivolous lawsuits and tort reform seem to be about protecting businesses from the people instead of protecting people from businesses.

Beyond the extortion problem, the Court system is facilitating invasion of privacy. Court cases are accessible on the Internet as public records, and lawyers can say anything they want. All their lies will be pumped directly to gossip aggregating services (or the press, if there's some matter of public interest). Normal individuals generally don't have the means to sue for defamation.

Private individuals no longer have a means to get justice - corporations have become top predators, and they use the legal system to chew people up and spit them out.

I'd very much like to volunteer for an organization that defends individuals from legal abuse if it exists. Please let me know.

RIAA are bunch of *beep*holes. When will they stop tormenting people and realise in their lowminded heads that p2p is the future of the music industry, and instead of making it illegal and sueing millions of people, they should include p2p in the future of music industry and make it legal and charge the downloads per song. But nooo, they have to be stupid and torment people while not realiseing that the way music was sold until p2p showed up on the net is obsolete. Capitalist *beeb*heads. You will never become intellingent.

I've briefly read several of the answers to Plaintiff Admissions and Interrogatories. I am having difficulty finding a similiarity particular to an Interrogatory that I am trying to answer with my girlfriend: hers asks for her to list anybody and everyone who may have had access to her computer. Is this a normal tactic? It seems that they want her to provide a list of relatives, friends or anyone else who may have been on the machine. What mother would want to throw her children or relatives into the RIAA's crosshairs? It seems that the RIAA wants her to interrogate anyone who has been in the house to determine who may have been near the computer. How accurate is a defendant expected to be? Should she provide a list of anyone who may have ever been near the computer? This entire process is agonizing, especially for people not trained in the law. I must also apologize to you for this obvious advice-fishing expedition.

Yes that is the RIAA's normal tactic. To turn the case into a McCarthyistic witch hunt, or as you call it, a "fishing expedition". Rounding up friends, relatives, neighbor's kids, etc. They will go on "fishing" forever, until the judge puts a stop to it.

The courts need to stop this practice.

I serve private schools and industry, and charities. I rebuild systems and networks with GNU/Linux, on which anonymous users post, download, compose, edit, critique, and parody works, as students, comedians, commentators.

I am awaiting the first RIAA attempt to quash FREE speech in this environment. Do you think this is any different than the Fair Use in libraries and universities?

If they have sued Mrs. Thomans, they will probably try to charge the technician, in the future, for having set up several thousand computer systems that have so many great tools and resources for study or parody, or copying.

As far as their claims of reduced sales revenue, everyone whom I know has boycotted the music industry due to their poor product and excessive prices, since the early 1990's!

Throw the bums out of court, they are thugs. Many new recording artists actually make their living, now, with the use of the Creative Commons License!

just right click the post with your mouse....

copy the source code....

and then arrange it by subject matter....

it would be a lot of work....

I came across this index upon researching RIAA litigation. It is a fantastic culmination of documents well-within the spirit of access to public information which our justice system holds paramount.

It is an affront to our legal system, justice, fair use, public domain, and the constitutional protections therein to argue against such an index. This collection is no more than what RIAA lawyers have access to through the court system or, more likely, through their own law firms shared data banks of litigation forms. The only difference is that RIAA's coordinated plaintiff's litigation through law firms would claim privilege for their firm's forms sharing (even though they are passed between co-counsesl) while, here, defense litigation is leveraging freedom of speech, technology and public domain documents to allow for legal progress. This collection speaks to a core component of this type of litigation, of public access and use of documents already in the public domain - a cornerstone of our American legal tradition all the way back to Blackstone and the accessibility of our legal system.

Kudos and thank you for donating time pro bono to post these documents and provide a valuable educational resource in the spirit of fair use.
