New lawyer brought in, presumably to handle oral argument, in Capitol v. Thomas

In Capitol v. Thomas a new lawyer -- Donald B. Verrilli, Jr., of Jenner and Block -- has been added into the mix by the RIAA, presumably to represent the record companies in the oral argument scheduled for Monday.

Verrilli pro hac vice motion

[Ed. note. Hmmm..... Why does this make me think the RIAA is a bit nervous? -R.B.]

  1. Looks like they called up their best closer. Win or lose, this is encouraging.

  2. Kip: I think they're using someone new for when the judge asks, "Well, didn't you know about the making-available-is-not-infringement precedent last year before the trial began?"

Somehow I think that they'll go to extreme lengths to avoid the mention of that fact.
