Associated Press DMCA and "Hot News Misappropriation" claims upheld in Associated Press v. All Headline News

In a New York case, Associated Press v. All Headline News, the Court has upheld the legal sufficiency of the the Associated Press's claims for "hot news misappropriation" and for violation of the Digital Millenium Copyright Act by removal or alteration of "copyright-management information" from AP's reports.

The defendant had not challenged the sufficiency of the basic copyright infringement claim.
