I believe in this case, unlike Thomas-Rasset or Tenenbaum, the defense attorney is well-prepared, well versed in relevant case law, and has good arguments ready to go. That's very encouraging.

Ray, in my as-yet unposted comment, I almost certainly said defendant when I meant plaintiff (being that it's a class action and not a normal P2P case) so you should probably just delete the comment. On the other hand, it was anonymous anyway. And please don't post this comment either.
