Landmark attorneys fees case Lava v Amurao to be argued week of May 18th

We have been advised that the appeal in Lava Records v. Amurao is likely to be argued during the week of May 18th.

This is the case, to be argued by Richard A. Altman, in which the Second Circuit will establish the principles to be followed within the Second Circuit in awarding attorneys fees to defendants in the RIAA's "throwing in the towel" cases -- i.e., the cases in which the record companies sued the wrong person, and then subsequently dismissed the case voluntarily.

  1. To this man this issue, supported by copyright law, seems so simple, straightforward, and obvious, as to really barely require any argument at all.

    Of course if we had a Loser Pays system in the first place...
