RIAA asks for additional discovery & extension of deadline in SONY BMG Music Entertainment v. Tenenbaum

In SONY BMG Music Entertainment v. Tenenbaum, the RIAA has filed a motion seeking to modify the discovery schedule by allowing them further discovery, and extending the deadline for summary judgment motions.

In their motion they ask for the judge to allow defendant only 2 business days to respond (motion was filed Thursday June 11th, asks for opposition papers to be due on Monday June 15th).

Plaintiffs' motion to modify discovery schedule, obtain new discovery, postpone summary judgment motions

I HIGHLY doubt this move is very professional, except to raise the issues surrounding discovery deadlines. That raises the question - is this childish tit-for-tat, or is it just simply questionable tactics?

  2. Why can't it be BOTH "childish tit-for-tat" AND "questionable tactics"?

The RIAA has a habit of citing our blog to judges, so please keep comments dignified and worthy of the important issues we are discussing, in keeping with our comment policies. If you see a violation of the policies, please let me know by email. You can post anonymously, but must sign off by giving us something to call you. Conversations among several people called "Anonymous" get too confusing. Thanks. Best regards. -Ray
