The RIAA lawyers sent a letter to the judges in UMG v. Lindor, before whom is pending a motion to exclude in limine the expert testimony of the RIAA's "expert" Dr. Doug Jacobson, to tell them that Dr. Jacobson testified in Duluth in Virgin v. Thomas.
What they did not disclose to the judges was that no objection to his testifying had been made in the Minnesota case.
