Ms. Lindor's Attorneys Bring to Magistrate Judge's Attention Misstatements Made by RIAA lawyers about Magistrate's statements at conference

In UMG v. Lindor, the RIAA lawyers, in support of their motion to strike Ms. Lindor's fourth affirmative defense, of copyright misuse, twice represented to Judge Trager that it was Magistrate Judge Robert M. Levy, rather than themselves, who had questioned the legal "viability" of the defense, and that Magistrate Levy had ordered them to file their motion.

Ms. Lindor's counsel have written to the Magistrate Judge calling both representations to Magistrate Levy's attention.

Should notifaction of this be sent Judge Trager, as well? I'm not a lawyer so does Mag. Levy have to tell Judge Trager of this mis-statement?

1. If I thought notification should be sent to Judge Trager I would have sent notification to Judge Trager.

2. The Magistrate doesn't have to do anything. If he feels that he wants to tell Judge Trager he will tell him.

3. There's an RSS feed.

Ok, then I'm confused. What is the point of notifying the Magistrate? So he can notify the judge if he feels its necessary and keep it in mind for future rulings?

(Keep in mind I'm legal illiterate -- like how some are computer illiterate.)

If I don't ask, I'll just be stupid instead of learning from the stupid question.
